1. Agreement to these terms
Welcome to BidCrafter ("BidCrafter", "we", "us", "our"). These Terms & Conditions ("Terms") are a binding agreement between you and BidCrafter. By clicking "I agree" or by using the service, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must stop using the service immediately.
2. Who may use BidCrafter
You must be at least 18 years old and legally capable of entering a binding contract. You must provide accurate information when you register, and keep your login credentials confidential. You are responsible for everything that happens under your account.
BidCrafter is an independent product. We are not affiliated with, endorsed by, or sponsored by Upwork Inc. You are responsible for ensuring that your use of BidCrafter is consistent with Upwork's own terms of service.
3. The service
BidCrafter helps Upwork freelancers find, score, and respond to job postings using AI. This includes our website and our Chrome browser extension, which reads your Upwork session to make authenticated requests on your behalf. You authorize us to act on your behalf through your authenticated session strictly for the functionality of the service.
4. Acceptable use
You agree not to:
- Use BidCrafter for any unlawful, fraudulent, or deceptive purpose.
- Submit proposals or content that is misleading, plagiarized, or infringes on third-party rights.
- Attempt to reverse-engineer, scrape, or abuse our APIs beyond documented use.
- Resell, sublicense, or share your account with others.
- Use the service in a way that violates Upwork's terms or disrupts their platform.
We may suspend or terminate your account at our discretion if we reasonably believe you have violated these Terms.
5. AI-generated content
BidCrafter uses large language models to generate proposals, scores, and suggestions. You acknowledge that AI-generated output may contain inaccuracies, omissions, or language that does not fit every context. You are solely responsible for reviewing and approving any proposal or content before it is submitted to a client. BidCrafter does not guarantee wins, hires, or any particular outcome on Upwork.
6. Subscriptions & billing
Paid plans are billed through Paddle.com Market Ltd. ("Paddle"), our merchant of record, on a recurring monthly basis until cancelled. Paddle handles billing, sales tax/VAT, invoices, and refunds on our behalf. You may cancel at any time from your billing page; cancellation takes effect at the end of the current billing period. We may change pricing with reasonable notice.

7. Intellectual property
BidCrafter, its branding, software, and content are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the service for its intended purpose. Proposals and other content that you create remain yours — you grant us a limited license to process and store that content solely to operate and improve the service.
8. Privacy
Our handling of your data is described in our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also acknowledge the Privacy Policy.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIDCRAFTER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
11. Termination
You may stop using BidCrafter and delete your account at any time. We may suspend or terminate your access for violation of these Terms, or for any reason with reasonable notice. Sections that by their nature should survive termination (IP, disclaimers, limitation of liability, governing law) will survive.
12. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or in the app and may require you to re-accept before continuing to use the service. Your continued use after changes take effect means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which BidCrafter is established, without regard to its conflict-of-law rules. Any disputes will be brought exclusively in the courts of that jurisdiction.
